Important Reminder: Employers Must Begin Using the New I-9 Form

We would like to inform you of an important update regarding the Form I-9, Employment Eligibility Verification, which will go into effect on November 1, 2023.

Starting November 1, 2023, employers are required to use the 08/01/2023 edition of Form I-9 for employment eligibility verification purposes.

We also want to bring to your attention that a revised Spanish edition of Form I-9, dated 08/01/2023, is now available for use in Puerto Rico. This edition is intended to assist both employers and employees in Puerto Rico by providing a Spanish translation of the form. It may also be used by other employers as a helpful translation aid.

Additional Note for E-Verify Users: Effective October 11, E-Verify has updated the options in the “Citizenship Status” section of the case creation process to align with the language used in the new version of Form I-9. Specifically, the option “An Alien authorized to work” has been changed to “A noncitizen authorized to work.” Therefore, for E-Verify users who are still using the 2019 version of Form I-9, if an employee attests in Section 1 to be “An alien authorized to work,” please select “A noncitizen authorized to work” when creating a case in E-Verify.

What do employers need to do?

Employers are required to commence using the new Form I-9 by no later than November 1st.
