OSHA Updates Testing and Mask Recommendations for COVID-19

Update Applicable to:
All employers.

What happened?
On August 13, 2021, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) issued updated COVID-19 guidance.

What are the details?
OSHA has updated their guidance to help employers protect workers from COVID-19. OSHA’s latest guidance states the following:

  • Recommends that fully vaccinated workers in areas of substantial or high community transmission wear masks in order to protect unvaccinated workers.
  • Recommends that fully vaccinated workers who have close contacts with people with coronavirus wear masks for up to 14 days unless they have a negative coronavirus test at least three to five days after such contact.
  • Clarifies recommendations to protect unvaccinated workers and other at-risk workers in manufacturing, meat and poultry processing, seafood processing, and agricultural processing.
  • Links to the latest guidance on K-12 schools and CDC statements on public transit.

U.S. Department of Labor Rescinds Joint Employer Rule from 2020

Update Applicable to:
All employers in the United States.

What happened?
On July 30, 2021, the U.S. Department of Labor (DOL) passed a final rule that will rescind the “Joint Employer Status Under the Fair Labor Standards Act Rule” (Joint Employer Rule) that was effective March 16, 2020.

What are the details?
The rule, effective September 28, 2021, will rescind the previously enacted Joint Employer Rule that began on March 16, 2020. The DOL believes the Joint Employer Rule narrowed the joint employment standard with a description that is contrary to the statutory language and Congressional intent.

What do employers need to do?
Employers should review the rule and any joint employment policies they have in place to update and prepare for the rescinding of the previous rule’s joint employment standards.

EEO-1 2019 and 2020 Filing Deadline Extended

Update Applicable to:
All employers who are eligible to file EEO-1 Data.

What happened?
On August 19, 2021, the U.S. Equal Employment Opportunity Commission (EEOC) extended the EEO-1 filing deadline.

What are the details?
The U.S. Equal Employment Opportunity Commission has extended the filing deadline for the 2019 and 2020 EEO-1 Component 1 Reports to October 25, 2021. The EEOC has advised that this is the final deadline and that all eligible filers must submit data by this date.  No additional changes to the filing deadline will be made.

What do employers need to do?
Eligible employers should read the update to be aware of the new filing deadline to submit their EEO-1 information to the EEOC.

Remote Worker Virtual I-9 Form Completion Extended

Update Applicable to:
All employers in the United States.

What happened?
On May 27, 2021, the Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) extended the virtual I-9 review timeframe.

What are the details?
OSHA and DHS have extended the time allowing employers to inspect I-9 forms virtually through August 31, 2021. The flexibility was originally due to expire on June 1, 2021, but ongoing precautions related to COVID-19 have allowed the extension.
