South Carolina Amended Labor Codes to Include Antisemitism

What happened?

On May 13, 2024, the South Carolina governor signed H 4042, which defines Antisemitism following the attacks on Israel and the rise of attacks against Jews and supporters of Israel.


What are the details?

Key Bites:

  • Adds the International Holocaust Remembrance Alliance’s definition of antisemitism to state law to be considered when deciding whether there has been a violation of discrimination policy, law, or regulation. 
  • Defines antisemitism as a certain perception of Jews, which may be expressed as hatred toward Jews. Rhetorical and physical manifestations of antisemitism are directed toward Jewish or non-Jewish individuals and/or their property, toward Jewish community institutions and religious facilities.
  • Nothing in the law may be constructed to infringe upon rights protected under the First Amendment or Section 2, Article 1 of the South Carolina Constitution, 1895, or conflict with federal, state, or local discrimination laws.
  • When assessing potential policy, law, or regulation violations related to discrimination, the State will consider the legal definition of antisemitism. Courts or relevant authorities will apply the same standards as other discrimination claims under this State’s civil rights laws, including Chapter 13 of this title.
