Illinois Employee Blood and Organ Donation Leave Act Coming Into Effect

  All employers and multi-state businesses with 51 or more employees  January 1, 2024

What happened?

On August 4, 2023, Governor JB Pritzker signed House Bill 3516, in which the Employee Blood Donation Leave Act is renamed to Employee Blood and Organ Donation Leave Act, providing paid leave to donors, and increasing the actual leave time.

What are the details?

The legislature decided to:

  • Rename the previous act to include organ donation in its title.
  • Amend the provisions to include organ donation.
  • Provide leave to employees who donated any organ as defined in the law with up to 10 days of leave.

The rest of the provisions remain unaltered. 

Business Considerations

  • Ensure that you have a leave of absence policy that covers organ donation and that it meets the updated provisions of the Act.
  • Have a process in place to manage blood and organ donation leave requests from employees (Vensure clients with leave administration services can consult the leave of absence team for questions.)
