What happened?

On September 18, 2024, USCIS announced that effective September 10, 2024, Green Cards will be automatically extended to 36 months for residents filing Form I-90.

Quick Summary:

  • USCIS extends Green Card validity by 36 months for Form I-90 renewals. Receipt notices and expired Green Cards prove status and work authorization.
  • Contact USCIS for an ADIT stamp if needed. This reduces HR workload by minimizing updates.

What are the details?

  • USCIS has updated Form I-90 receipt notices to extend Green Card validity by 36 months for new renewal requests.
    • On September 10, 2024, USCIS began printing amended receipt notices for individuals with a pending Form I-90.
  • These receipt notices, along with an expired Green Card, serve as proof of status and employment authorization, helping applicants during longer processing times.
    • If you need proof of your status while waiting for a replacement Green Card, contact the USCIS Contact Center to request an ADIT stamp after filing Form I-90.
  • To show work authorization and status, Green Card holders need: (1) a receipt notice with the 36-month extension, and (2) the expired Green Card. If the amended notice is not received, contact USCIS to request it.
  • A benefit from this is that with the longer extension period, there will be fewer instances where employees need to update their employment authorization documents, reducing the administrative workload for HR departments.

Business Considerations

  • Employers must accept the updated Form I-90 receipt notice, which now extends the validity of Green Cards by 36 months, along with the expired Green Card, as proof of employment authorization.
  • Employers need to update their I-9 forms to reflect this change. The receipt notice and expired Green Card together will be valid for I-9 verification purposes.
  • Employers should recognize the USCIS’s decision to extend Green Card validity to 36 months for Form I-90 filers as a crucial support measure for lawful permanent residents (LPR). This change helps employees maintain their legal status without interruptions, ensuring continuity in work, travel, and other essential activities.
